Terms and Conditions Like Fridays

Like Fridays is a trade name of Apochi B.V., a limited liability company (besloten vennootschap met beperkte aansprakelijkheid) having its official seat (statutaire zetel) in Amsterdam, the Netherlands and registered with the Dutch trade register under number 57893446. These Terms and Conditions apply to all our services directly or indirectly made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our (mobile) website or any of our applications through whatever platform, you acknowledge and agree to have read, understood and agreed to the Terms and Conditions set out below.

  1. Interpretation

Unless a contrary indication appears, any reference in these Terms and Conditions to:

  • a clause is a reference to a clause of these Terms and Conditions
  • these Terms and Conditions or any other agreement or instrument includes all amendments, supplements, novations, restatements or re-enactments (without prejudice to any prohibition thereto) however fundamental and of whatsoever nature thereunder
  • a person includes any individual, firm, company, corporation, government, state or agency of a state or any association, trust, partnership or other entity (whether or not having separate legal personality) or two or more of the foregoing
  • Like Fridays, User or You includes its successors in title, permitted assigns and permitted transferees
  • clause headings are for ease of reference only
  • a provision of law is a reference to that provision as amended or re-enacted
  1. Definitions

In these Terms and Conditions:

  • Accommodation means the accommodation offered by the tourism business
  • Accommodation Provider means the provider or operator of an accommodation, which is offered through the Portal
  • Claims has the meaning given thereto in clause 11
  • Portal means the website portal operated by Like Fridays and the services and benefits offered through it
  • User or You means the individual person(s) registered on the Portal as a User
  1. Use of the website

As a condition of your use of this website, you warrant that:

  • you are at least 18 years of age
  • you possess the legal authority to create a binding legal obligation
  • you will use this website in accordance with these Terms and Conditions
  • you will only use this website to make legitimate reservations for you or for another person for whom you are legally authorized to act
  • you will inform such other persons about these Terms and Conditions that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto
  • all information supplied by you on this website is true, accurate, current and complete
  1. Registration

4.1 In order to use the Portal, you must register and open an account by providing your email address and your name.

4.2 By registering and opening an account, the User agreement is concluded.

4.3 The User must ensure that the electronic messages from Like Fridays reach You and their delivery is not prevented by security-checking safeguards.

  1. Payments

The payment may be made by either using the payment services offered by Like Fridays (currently VISA or MasterCard) or by paying directly upon arrival at the Accommodation.

  1. Discount codes

Discount codes are issued at Like Friday’s sole discretion. Any same discount code may be used a maximum of one time per person. It is not possible to cumulate several discount codes.

  1. Bookings

The membership authorises You to apply for a booking with the Accommodations listed on the Portal. The entitlement to a booking only applies if the Accommodation Provider offers the booking at the special rate on the required booking date.

  1. Limitation of liability

8.1 The details about Accommodations on the Portal are entered and maintained by the Accommodations and the Portal. Like Fridays assumes no liability for the correctness or completeness of the offers or information provided by the Accommodations.

8.2 Like Fridays is specifically not liable for deviating, incorrect or non-current price quotations of the Accommodations on the Portal.

8.3 Claims for damages due to breach of duty and from illicit acts, as well as claims for compensation of futile expenditures, are excluded vis-à-vis Like Fridays, as well as its legal agents and vicarious agents, unless the damage was caused maliciously or with gross negligence.

  1. No assignment User

The rights and obligations of a User under these Terms and Conditions cannot be transferred, assigned or pledged in accordance with section 3:83 (2) of the Dutch Civil Code.

  1. Reservation of rights

10.1 Like Fridays reserves the right at our sole discretion to deny access to anyone to this website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms and Conditions.

10.2 Like Fridays reserves the right to amend these Terms and Conditions at any time and without giving reasons. The new Terms and Conditions will be sent to You by email. The new Terms and Conditions are deemed as agreed, if You do not object in writing to their validity within 14 days after receipt of the e-mail.

  1. Disputes

Like Fridays is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section. You agree to give us an opportunity to resolve any disputes or claims relating in any way to the website, any dealings with our customer service agents, any services or products provided, any representations made by us (the Claims) by contacting customer support via support@likefridays.com or +312611770. If we are not able to resolve your Claims within 60 days, you may seek relief as set forth in clause 12 (Governing law and jurisdiction) below.

  1. Governing law and jurisdiction

12.1 These Terms and Conditions an any (non-)contractual obligations arising out of or in connection with it are governed by Dutch law.

12.2 The court (rechtbank) of Amsterdam, the Netherlands has exclusive jurisdiction to settle at first instance any dispute arising out of or in connection with these Terms and Conditions.

Like Fridays is committed to protecting and respecting your privacy. This notice describes how Like Fridays collects and uses personal data and the rights you have in relation to your personal data. This notice was last updated on the above date and may be amended from time to time, so please do check for any amendments. Any significant changes to this notice will be clearly indicated on the homepage of the website.

13.2 What personal data we collect

We collect personal information about individuals who choose to register for our website and services. The personal data we collect consists of an individual's name and email address.

13.3 How we collect personal data

Like Fridays collects the personal data detailed above in relation to individuals who: (i) register for an individual account or (ii) subscribe to receive email alerts from Like Fridays. Such data may be provided to us by you filling in the appropriate forms on our website. You may also provide us with personal information if you contact us by email, telephone, post or otherwise.

13.4 How we use personal data

Like Fridays uses the personal data it holds to: (i) provide membership benefits and services to you; (ii) communicate with you about our services (e.g. alerts on bids); (iii) to process and respond to requests, enquiries or complaints received from you; and (iv) fulfil our legal obligations. Like Fridays only uses personal data for legitimate business purposes and in accordance with data protection legislation. In particular, we use the data we collect to deliver services. We may not be able to provide you with some of the features and functionality provided by Like Fridays without access to your personal data. Like Fridays has a number of legal bases for processing personal data, primarily being the legitimate business interests of Like Fridays in the provision of membership services. We also process data for which you have given your consent (which you may withdraw at any time through your online account settings or by contacting us at support@likefridays.com) and where the use and processing of data is necessary to perform a contract with you. We only request information necessary for these purposes and use this in a proportionate manner.

13.5 How to manage your email alerts

We may ask whether you wish to receive email alerts from us and this will be presented to you as an option on the appropriate application form. We will not send you email alerts if you ask us not to. If you have agreed to receive email alerts but you later change your mind and no longer wish to receive these emails, you can change your preferences at any time by amending your personal profile on the website. You can also contact us directly at support@likefridays.com and request to be removed from our distribution lists.

13.6 Disclosure of personal data

Your personal data may be disclosed to certain third party service providers (the "Service Providers") in order to allow us to deliver our membership services to you.

13.7 Storage and processing of personal data

The information that we collect is stored and processed in the European Economic Area (" EEA"). The arrangements with our service providers may involve transferring information outside of the EEA. However, in these situations Like Fridays will ensure that transferred information continues to be protected by appropriate safeguards.

Like Fridays has reasonable administrative, technical and physical measures in place to protect your personal data. We also require our service providers to have adequate security measures in place for the safeguarding of personal data processed by them and ensure our contracts with them require the service provider (and any sub-processors) to abide by their requirements under data protection legislation.

Your principal rights under data protection legislation in respect of the personal data that we hold about you are:
• the right to access that personal data (for which we may charge a small administration fee);
• the right to rectification of that personal data;
• the right to erasure of your personal data;
• the right to restrict and/or object to the processing of your personal data;
• the right to portability (i.e. transfer) of your personal data; and
• the right to withdraw consent to processing of your personal data.
We provide you with tools to access and control your personal data (namely the personal profile section of the website). Please note that if you have any concerns about the handling of your personal data, you have the right to complain to a supervisory authority.

13.10 Updating your personal data

We want to make sure that the personal data we hold about you is accurate and up to date. You may ask us to correct or remove any information that you think is no longer up to date. You can update, correct, or delete your personal data at any time by accessing your personal profile on the website or by contacting Like Fridays at support@likefridays.com.

13.11 Third party links and domains

The website may include links to third-party domains (or applications). Please note that if you click these links you may be allowing third parties to collect your personal data. Like Fridays has no control over these third party domains, and cannot be responsible for their individual privacy statements. You should ensure that you read the privacy notice of every domain you visit.

13.12 Data retention

We retain personal data for as long as your account is active and otherwise as long as needed to fulfil the purposes for which it was collected, unless we have a legitimate interest in retaining the data for longer periods or are otherwise required to by law. We also keep personal data for as long as necessary for our legitimate business interests, to comply with our legal obligations, resolve disputes and enforce our agreements and legal rights.
